$4M LASIK Award Falls After Witness Recants

Superior Court Judge Kenneth Lee suspended the largest reported verdict in a suit involving laser-corrective eye surgery and ordered a new trial after Dr. Jeffrey Machat, a key plaintiff’s expert, said his testimony was wrong. Steve Post, a former commercial airline pilot, was awarded $4 million last May after alleging that doctors at University Physicians Inc., a University of Arizona affiliate, had fallen below the standard of care by failing to impress upon him the risks of laser-assisted in-situ keratomileusis. Post v. University Physicians Inc., No. C20011817. Post was forced to give up his job as a captain for United Airlines as a result of the diminished night vision he experienced following the operation.

I’m a Tidewater Community College student, whose been watching this case recently, and I am disappointed that the doctor backed down, and left Steve Post. I thought he already received the $4 million, since it was 2 years ago. I guess other doctors put alot of pressure on the witness, it’s not fair!
