Bank of America may be sued in state courts over paycheck-cashing fees, a federal judge ruled last week, sending the lawsuit back to a Los Angeles County court.
U.S. District Court Judge S. James Otero “rejected claims by Bank of America that federal law should exempt it from being sued under state laws,” The Associated Press reported.
BofA also argued that it might be treated unfairly in a L.A. county court.
“In other words, of all the banks in the world, Bank of America is the most visible bank in California,” Otero said. “Yet Bank of America suggests it will somehow be unfairly treated in California because it is a foreign corporation. The court does not agree.”
The Lawsuit, filed in April by attorney Nicholas Roxborough on behalf of the Karis House teen shelter in Visalia, claims Bank of America violated California’s unfair business practices law when it began charging a $5 paycheck-cashing fee without giving prior notice.
