Thousands of consumers nationwide who purchased the antidepressant drug Remeron or its generic equivalent, mirtazapine, may get cash back based on their out-of-pocket expenses.
The cash recovery is a result of a $36 million nationwide settlement with drug maker Organon USA Inc. and its parent company Akzo Nobel N.V. for allegedly improperly monopolizing the U.S. market for the drugs. The settlement is subject to approval.
The lawsuit alleged that Organon unlawfully extended its monopoly by improperly listing a new “combination therapy” patent with the U.S. Food and Drug Administration. In addition, the complaint alleged that Organon delayed listing the patent with the FDA in another effort to delay the availability of lower-cost generic substitutes, resulting in higher prices to those who paid for the drug.

In December 2000 I was on Reglan for GERD,one of the side affects was severe depression, my family Dr. put me on Prozac, I kept getting more depressed. My Dr. made an appointment for me to see a Psychiatrist through Catalina Behavior Health Services–She put me on Remeron, one tab per day. In less than a month I was feeling good and back to normal. In 2001 I was prescribed Mirtazapine 30mg one tab per day and have been on it since, will be on Mirtazapine the rest of my life.

I have been taking Remeron for years, and noticed that the price has gone up dramatically. The last prescription cost me $48. For some reason, I got the same prescription from the same pharmacy yesterday for $14.00!! The druggist told me it was because they had a new distributor. YAY for the Remeron “monopoly” case being settled!!
I have taken Remeron for years, and would not do without it, before remeron I could never sleep now I get a good nights sleep. And do not understand what this settlement is about, I am still taking remeron and have no intentions on not taking it.
