Judge Postpones Liability Phase of Two Fen Phen Lawsuits

A Philadelphia Judge has postponed the liability phase of two fen phen lawsuits until July 25, 2005, New Jersey-based Wyeth said on May 27 in a statement.

The parties requested the second phase of the trial be postponed until July 25 to permit Wyeth and the plaintiff�s attorneys to pursue discussions of a possible resolution of similar fen phen cases.

�These discussions are taking place within the context of the settlement process that is currently underway with lawyers representing thousands of plaintiffs nationwide,� Wyeth said.

On Tuesday, May 24, the jury hearing the first phase of the trial returned a verdict finding that each of the two plaintiffs, who had claimed heart valve injury, had been damaged in the amount of $100 million. Wyeth moved for a mistrial following the damages verdict and that motion will also be adjourned until July 25.

Should the trial resume, the jury would be required to determine if Wyeth is liable and required to pay the damages found in the first phase of the trial.

    Has anyone figured out how much Wyeth would have save had they settled all the cases and not paid millions to lawyers to fight them? At over 23 billion,so far, seems to me we could have all shared in less then that!

    I search almost daily and can find no news…I can’t even get my own lawyers to keep me updated…and if anyone knows what happened to the case to readjourn on July 25 in Philly I would really like to know what happened?
