Class Action Lawsuit Filed Against Palm Over Treo 600 & Treo 650

Three California consumers filed a class action lawsuit last week against Palm, Inc., accusing the company of selling defective Treo 600 and Treo 650 smartphones.

The lawsuit, filed in the Superior Court of California for the County of Santa Clara, alleges that both devices suffer from numerous inherent defects that impair its functionality. These alleged problems include:

� Extremely poor sound quality manifesting itself in a buzzing sound that is heard by the recipients of telephone calls made from the Treo 600,

� Lost calls resulting from the Treo 600 spontaneously resetting itself in the middle of a phone conversation,

� Frequent freezing and crashing in the Treo 650 that requires the use of a hard reset during which all stored information is lost.

“We allege in our complaint that Palm has deliberately created a cycle of defective products whereby owners continue to receive defective phones until either they tire of the process or their warranty runs out,” Hector R. Martinez, attorney for the plaintiffs, said. “Each of the plaintiffs has attempted to have their phones replaced by Palm, instead of new phones they received what appear to be refurbished phones that had been returned to Palm by other customers — these replacement phones suffered from the same problems that were originally complained about.”

This case was jointly filed by the Law Office of Mallison and Martinez and the Rothken Law Firm.

    I had the Treo 650 for almost a year haveing one problem after another. When that phone was stolen I had to have it replaced using my insurance. The first phone that I recieved had to be sent back due to a screen problem. The second phone had to be taken into a Sprint store because it would not pick up the network. All in all, almost two weeks of my busy schedule was interupted to get the problem fixed.

    I have now had 4 Treo 600s on T-Mobile. My first phone had problems with the speaker phone, which after several resets instructed to be done by T-Mobile support, the speaker worked perfectly, but, unfortunately the regular phone did not work - this one was replaced. I had the 2nd phone for about 5 months, it mostly worked, except it needed to be reset every few days - if not, all incoming calls would automatically go to voicemail although the phone was on, but then all of sudden stopped one day, totally died - they replaced that one. The 3rd phone actually worked well, I only had to reset it once a week or so, but after 6 months the screen died. I had to pay $75 to replace that one. Now, I am on my 4th phone. This one now needs 3-4 resets a day to work and today it decided on a new problem. Everytime I access the call log, my phone totally resets. I am trying to synch the phone to my PC, it does not synch. I tried copying my important records to the SD card - nothing. I have been on hold with T-Mobile tech support for 1 hour - they can’t help, now they are putting me onto Palm support. I told T-Mobile I want a full refund and will buy a real PDA device like Motorola, Samsung or Q-Tech. My wife has a Samsung 105, when we drive together in the car in low coverage areas, she will have 2-3 bars of signal, I have 0-1, she has never had to reset her phone.

    I would really like to be part of the Class Action lawsuit. I have all of my problems recorded and would love to see Palm go out business. I can’t think how time I have spent but it’s several weeks from my busy schedule as well.
