Ed McMahon Settles Toxic Mold Lawsuit for $7M

Former “Tonight Show” sidekick Ed McMahon obtained a $7 million settlement from several companies he sued for allowing toxic mold to infest his Los Angeles home, making his family sick and killing his dog, a national mold litigation magazine reported.

McMahon ended the lawsuit with all but one of the companies in confidential settlements.

But earlier this week, a Los Angeles Superior Court judge ordered the settlement amounts made public.

Travelers and American Equity Insurance companies and other related insurance entities settled with McMahon for more than $5 million, according to the hearing transcript. Four mold cleanup firms and two insurance adjusters paid the rest of the sum.

    I am in similiar lawsuit, I have lost everything due to black mold, I myself am slowly losing my fight for life, this has me deathly ill as my system has no tolerance to fight the toxins that i had been exposed to for some time…I have developed severe asthma, have recurring blood clots that have caused pulmonary embolism several times in these last 2 years. I constantly suffer from pluerisy around my lungs. I have lost my home and all my material possesions, the most important to me being the pictures of my childrens childhood and graduations and accomplishments. It has been over 2 years since I have had to leave my home. It has been remediated 4 times to no avail. I’m still unable to live in it. I just sold it and took it as a loss. I have an attorney working on my case but it seems he’s not knowing what he should be doing. Can you please tell me who representd you in your case?     Try some Olive leaf. take 1000 mg day. You will sometimes feel a “die-off’ reaction from the dead fungus, mold and yeast toxins. Just keep taking the Olive leaf. Make sure you get a good kind–I found “Solaray” is best–but I am sure there are plenty other ones out there. In addition to Olive leaf, take 50mg Niacin a day, get a bottle of colloidal minerals, and make sure they have molybdenum in it, take them every day. Get some Panthethine and follow dosing directions every day. Drink, rather sip, lots of water–ounces equal to half your body weight every day. Eat a high protein diet, with no sugars from any source, not even fruit. If you must eat fruit, eat apples, and not too many of them. The pathogens feed on the sugars. When they begin to weaken, they will actually make you crave sugar to keep themselves alive. No fermentation or alcohols of any kind. No vinegars. 800 IU Vitamin and 200 mg Vit. C daily. Try this, I know it works, it works for me. You will feel better in about two-three weeks. You will have to modify your lifestyle like this for years, before it goes completely away. No diet cokes or sodas, use “Stevia” or xylitol to sweeten. None of these things will contraindicate with any meds, except MAYBE the niacin. Ask your doctor if it will contraindicate with your meds.     I know you hear a lot of Mold stories, so hears another one in Boise Idaho.

    In November of 2001 we saw a brand new home being build and decided to purchase and added many extra amenities.

    In March of 2002 we moved into our brand new dream home. Four days after living in the home we saw water coming out onto our concrete patio next to the master bathroom. My husband went into the crawl space to investigate and saw a small amount of mold growing. The builder was contact and a plumber was sent out.This was on a Friday. After an hour of deciding there wasn’t a leak we turned on the shower and showed them water was spraying out and that mold was growing. They fixed the leak and left. On Monday a local company came to our home with a spray bottle and went into the crawl space. They came out and told me that the mold had spread clear across the entire crawl space and they needed to get more help. The builder was contacted and told us the mold was dead and no harm to us but he would clean it for a small amount of money if we signed a release waiver. Obviously we didn’t sign anything and got an attorney. After living in the home for 2 months we became so ill we could think straight. From diagnosis from strep throat to mononucleosis, ear infections bronchitis, rashes, nose bleeds, ext, we moved out and left all our possession in the home and haven’t been back since. We had to put down our 2 cats because no one would take 3 animals. We had to purchase everything from cloths to toothpaste to live. It’s been 1 1/2 years since we have lost everything. The story goes on and one.

    I have a mold problem I am fighting which made my son very sick. I highly recommend contacting Dr. Ritchie Shoemaker in Pocomoke, MD. we drove there from Florida and it was well worth it.     We are a family in Northern California who were awarded $2.7 after a 3 week trial. All the stories are so similiar to ours which is quite common with mold. We lost everything and had to start over also. I never accepted that it was “okay” for the persons involved to not take responsibility for what was happening to my family. There is no end to the problems mold will cause you with your health. Even if you move out of the environment your are still on meds that have sometimes very serious side effects. Medicines that you wouldnt be on if it wasnt for the poor quality of help that caused the mold to begin with. after 3 years of living in a mold free home, my husband developed a heart condition from the asthma meds and ended up with a pacemaker. He is only 34………..Dont give up on your fights and if you need legal help we know a great attorney. good luck!

    Dr. Dean Edell talked on mold the other night. He claims that molds have been around forever and are being blamed for all sorts of medical problems and it is nonsense. He is accusing doctors and attorneys of milking the supposed problem.

    I’m quite ill-I have blurred vision, headaches, chronic fatigue, dizziness, and neurological problems. It is a classic die-off reaction. I’ve explored everything else and need to know if these symptoms could be related to mold. I’ve been in a psych hospital 4 times this year and I don’t have these reactions very often when I’m gone. I don’t leave the house, but I think there is a connection because when I come back home I get more and more sick. Please help!!! Thanks Linda

    Linda: My wife has been very ill from toxic mold exposure for the past three years. We tried to find help through local medical sources for 17 months before finally going out of state. She has been seeing Dr Andrew Campbell in Spring, Texas since February 2003. Our experience with Dr Campbell has been a positive one.

    Since February of 2004 my husband has had to live in deplorable conditions with a fallen kitchen roof and we find the ceiling carried 3 types of toxic mold given to us in a Health Department report after we bought the test.

    Myself, I was drenched in the horrid water coming through when the bowl to collect it overturned on me as was sick for 3 weeks.

    Who serously handles these cases and knows how to win? I live in Maryland.

    With all due respect, Dr. Dean Edell studied zoology and was an ophthalmologist and surgeon, so how do you think he know so much about the illeness causes by the miotoxins released by molds? Molds are mentioned in Leviticus in the Bible (Chapter 14).

    Here’s some other history on mold that might give you a reason to look at this more closely:

    Molds were used by the Spartans in their war against Athens in 430 B.C.

    There were 65 mold epidemics worldwide between 1591 and 1889

    1920’s: Fatal kidney disease caused by mold in Denmark and the Balkans

    1930’s: Stachybotrycosis:30% of horses in Russia from eating moldy hay 1944: Alimentary Toxic Aleukia epidemic in Russia from eating moldy bread; 10% of the population was affected and it was often fatal

    1952: Aflatoxicosis: killed poultry that ate moldy corn (Aspergillus)

    Stachybotrys chartarum

    First identified and described by a scientist from wallpaper collected in a home in Prague in 1837.

    Toxic effects of Stachybotrys reported as early as the 1920s.

    Reports and surveys on mold in homes have been published since at least the late 1970s.

    In 1986, the injurious effects of trichothecenes - a mycotoxin produced by Stachybotrys chartarum and a few other molds - were reported from a study of a family in Chicago. That report, by Dr. Croft, said that Stachybotrys could be commonly found in homes with water damage, could grow undetected behind walls and could grow profusely on sheetrock.

    my three children and i are living with the stacchybotus? spekking, aspergillus, and three other highly toxic molds. We have severe respiritory illness,chronic fatigue,nosebleeds,headaches, this is fron the builder covering up a leak with two layers of sheetrock. i can’t get any help, because we just declined mold insurance the year we found this. we have lived here for 13 years, and did’nt know why we were sick until we found this defect. Who can help us pease tell me of a lawyer that will help us on a contingency basis. We truely are ill, and doctors don’t believe mold can cause this. We have a huge hole in our ceiling covered with plastic, because it costs 40,000 dollars to remidiate. losing my mind from stress. my kids and i are constantly on steroids.PLEASE HELP… we live in Texas.

    I am Diana, I am also a mold victim. I have been very ill for almost 4 years. Very long story, but my illness is due to toxic mold that was in our home. Rebuilding our home was a big nightmare, but that was only the beginning. After seeing several doctors and having a neurologist who believed in me, I found my way to Dr. Campbell in Spring, Texas. With the love and support from my husband and our three grown wonderful children I would not have made it this far. I have been a patient of Dr. Campbell for about a year and a half. I was diagnosed a year ago with CIDP (Chronic Inflammatory Demyelinating Polyneuropathy) a neurological disorder and a fungal infection due to toxic mold exposure. The lab results found 15 different mold antibodies in my system, 5 which are toxic due to the mold expose from our home. In May 2004, I was also diagnosed immune suppressed. My health declined rapidly from October 2003 until May 2004. During this time we battled with my health insurance to get the medical treatment I needed but did not have any luck. At this point Dr. Campbell and his staff could no longer sit back and watch my health keep declining. I started my first round of weekly IVIG treatments for 12 weeks. Due to insurance issues my treatments were stopped for 6 weeks, still no luck from my health insurance. I have since then started my second round of IVIG therapy, I am still very ill. I have all the faith in the world being under the care of Dr. Campbell, his staff and receiving my IVIG therapy. I saw Dr. Campbell just this past week. I will need to have several rounds of IVIG therapy. I have a long way until I will even begin to feel normal again. I can’t wait until the day will come when I can actually smile when I come into his office. I just have to be patient, have faith and the love from my family.

    I also had the same home owners insurance Travelers as ED McMahon. I would really like to speak with him and get some information on the attorneys who filled his suit. Or any other Attorneys who may could help in a suit against Travelers for taking my life away.

    hi all–i was a nurse till 1997. at that time, i worked in a local community hospital…till i became deathly ill. i went to bed one evening with a backache, & pretty much awakened paralyzed, with SEVERE pain in my back & legs. i lost ALL bladder & ALL bowel functionality, not to mention other things from waist level down. i was in a wheelchair nearly a year, while i relearned to walk as though i were a young babe. my rt. ankle & toes are still paralyzed…my neuro says its “probably a virus or auto immune response.” that’s b.s.! i KNOW its from toxic mold found in my workplace, because like 9 other employees SUDDENLY were unable to walk. i have fatigue, memory deficits, rashes, no balance to speak of, i walk with a cane, etc etc. i could go on & on & on….

    one day i WILL prove this. anybody else have a similar story? i’d LOVE to hear about it!

    our dog stays in the basement during the past 2 months. he became really ill all of a sudden. i have seen mold down there from time to time.

    does anyone know if Ed McMahon has a dog? Did his dog get sick too? My wife is worried sick about Rocky. Has anyone know of a lawyer who has taken on a similar case?

    I have no idea if this site is still active but I bought a home that had hidden mold isssues. I lost about 20,000 trying to fix it, gave up and did a short sale on the house. The bank was great (they didn’t want the house either) but I just found out I have to pay taxes (8000) FOR THE CANCELLED DEBT. IRS considers it income.

    My health issues are awful Bursitus had settled in my hips,my sinuses and lungs are weird too.. I have been out of the house over a year and have done all kinds of cleansing.

    I’d love to hear how McMahon’s wife cleaned it out of her system. I heard that she was quite ill. I am sick of pain….I use to work out all the time and now am like an old lady…

    It was heartening reading all of your stories. I’ve been ill with upper respretory problems for 6 months now. A few weeks ago, my sister-in-law asked me if my illness could be the result of mold building up following the flooding of my condo in early January. I poo-pooed her question at first, but started thinking about it more and more. Sure enough, I’ve put 4 mold test kits in different rooms and they are showing several different kinds of mold. Now, I go back to the insurance company, which will go back to the contractors who did my repair/mold remediation work. There were a few places they didn’t treat — which I thought nothing of at the time, assumiing they were the experts.

    If it comes to it, does anyone know a good lawyer in L.A. who specializes in this kind of litigation?

    I have a website that tells my story, but .. in 1998, I awoke to the world spinning out of control, literally. MRI, CAT scans, BEAR test, 2 neuros, 5 ENTs ..nothing. Little mini long haired Dachshund had been throwing up every day for 7 months, tests showed nothing. Discovered black mold. Insurance would not help. Moved out immediately per dr. orders. Went to 9 different lawyers til found one to take the case, wasted 8 years of my life keeping diaries, taking photos, yada yada .. on XMAS eve day, got a letter saying judge had thrown the case out because it is MOLD. I am in Kansas. Other people are winning .. this judge ruined my life. Actually the mold ruined it. Balance is shot, migranes in eyes, memory loss, on disability, falling through the cracks. Lost my entire family in the past 8 years, all dead. Nobody but me and my little dog. I wish someone could help.

    I have been trying to find a doctor in Alabama who knows how to treat a patient who has been exposed to toxic mold. I have had many illnesses in the past three years, more than my whole lifetime (55 years old). Have been living in a house that sweats, runs down the walls even after I wash them with clorox. Have contacted the health dept. to try to get someone to test for toxic mold, but to no avail. I’m sure that my chronic fatique, unexplained nose bleeds, coughing, sneezing, etc., etc. is cause from toxic mold, but, no one will believe me. Please help!! I’m so tired of being sick.

    I was exposed to mold in my office this year. I am now not able to work and am tired all the time. My lymph nodes and mammary glands are all swollen and very painful. My doctor tells me there is nothing he can do and that I will have this permamently. I need to know if there is anything I can do and I also need a good attorney??? Help anyone??

    I have been through this terrible oddessy. We lost our home and health to mold. I feel like no one understands unless you’ve been there. We lived in a camper in our driveway for several months and discovered somehow it had been cross-contaminated. Now we are waiting for permission to have the house torn down. It’s such a shame. The home is only 8 years old but it has a major construction defect. The builder is out of business and no where to be found so we have to pay for it all. I am happy for one thing. We have been getting good advice and found the right doctors. Theres a great website called http://www.mold-help.org and it has all the information you need to know. The folks there helped us out and now we can only look forward. I wouldn’t wish this stuff on my worst enemy and I feel sorry for anyone who has to go through this with no help.     I am a Registered Nurse disabled by toxic molds. I have had three lawyers work on my case, but have done nothing to help me get the settlement that my case has been estimated to be worth. I have had all the tests done; even blood tests showing antibodies to the toxic molds I have been exposed to. I have to take 20 medications but I am still very ill. I need help NOW. This case has been going on since 2000 and I have not found an attorney that has really been able to help me. PLEASE HELP ME. I HAVE DEVELOPED ADRENAL DISEASE, CHRONIC LUNG DISEASE, LUPUS, CHRONIC SINUS DISEASE, CORNEAL ABRASIONS, AND THE LIST GOES ON. I AM PSYICALLY, EMOTIONALLY,AND FINANCIALLY DEVASTATED. I NEED HELP.     I rented an apartment for 6 years with all kinds of problems which led to my daughter and me getting real sick from mold. It started with bruises, sinus infections, vomiting, acid reflux, memory probs, and then it got to a point where my daughter was on a nebulizer and we both have seizures. I didn’t know it was mold until I was on the Mold Help website and i was reading about the stories and symptoms of other people and then it all clicked. Then Susan helped me find someone to test the place and the counts were so high the man told us to leave and not look back. We started to feel releif as soon as we left. Its funny how my family doesn’t understand how or why we got sick. i had to live in my car for a few months until I moved in with my sister. Now I am seeing Dr. Ordog and he has helped us a lot. We still have a lot of cognative probs but other than that i think the infection is almost over. The whole ordeal wasted 9 years of our lives. I only want to forget this mess and get on with our lives. My daughter has severe learning problems and its funny because she was fine before the mold. I am glad it’s over. I don’t have any desire to sue because its to expensive. I have learned through this that there is no justice in this cuontry. They know about this problem but don’t want any one else to know since it’s too expensive to fix.

    My story is really no different. I was in perfect health in 2003 when I moved into a temp residence while we built our dream home. A nice location right on a lake. After a few months I became very ill. Body pain everywhere. I went to my doctor who did tests, nothing, more doctors more tests for 1-1/2 years, till a friend told me of someone who had similar symptoms and it turned out to be mold. I tested the house, sure enough, high mold count everywhere, duct system, etc. But after 2 years exposure, the damage was done. I can’t breath, walk for 5 minutes and I’m exhausted, any activity, work, etc. and I have to take a nap. Don’t sleep well, high weight gain that is going down on it’s own since getting out of the house, but now I have nerve damage, sight damage and brain damage. NO doctors in Ct know anything about mold poisoning. Found help on the net. Doctors, lawyers, but money won’t get you better, and I, as so many you read about, will not get better for many years, if at all. Getting out of the house has helped some, but some symptoms are getting worse. My lungs have only 25% of original capacity, and I never smoked. Best we can do is try different treatments and hope for the best. I know what many of you are going through, we are all in the same boat.

    I was exposed to stachybotrys.sp in march 05. In april 2005 I lost my sense of smell and tast and as of September 2005 I still have the same problem along with a lot of other health issues.

    I have a 12 year old son and he has been sick for 5 yrs due to mold in his school!!! just put 2and 2 together and figured out that it is mold that is causing migraines, severe nose bleeds, coughing up blood, nausea, vomiting, upper respiratory problems, acid reflux, and the list goes on and on… I need a doctor who will diagnose this as there are none in Indiana, or I do not know of any. If any one knows of any good toxic mold doc’s please e-mail me.. I am desperate to know the truth and have contacted legal counsel. I need to get him out of the school but was advised that I should not remove him until after testing is done… please help!!!

    i have had mold exposure and had serious symptoms and saw several doctors.     does this sound like mold?… nose bleeds, dermatitis (sensitive skin), swelling of the cheeks, eyelids, and around the mouth, dark circles under the eyes? i had a leak in my house which went unfixed… it all points to mold, but my bloodwork came back negative for common molds and stach… what do you think? second opinion?
